These Terms of Service ("Terms") govern your access to and use of the LinkRivers web operations platform, including the website at linkrivers.com, the application at app.linkrivers.com, APIs, and related services (collectively, the "Service"). The Service is operated by LinkRivers ("we", "us", "our"), a company registered in the United Kingdom.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
LinkRivers is a web operations platform that provides uptime checks, performance tracking, SEO tools, real user analytics, error tracking, transaction flow tracking, bot protection, status pages, integrations with third-party services, and automated issue remediation (Autopilot). The specific features, functionality, and availability of the Service may change over time as we develop and improve the platform.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for changes that materially affect your use of the Service, except in cases requiring immediate action for security, legal, or operational reasons.

The Service is available in multiple tiers, including a free tier and paid tiers. Current pricing and feature details are listed on our Pricing page. Features, limits, and prices may change. We will provide at least 30 days' notice before increasing prices for existing subscribers.
Paid subscriptions are billed in advance on a monthly recurring basis through Stripe. By subscribing to a paid plan, you authorise us to charge the applicable fees to your chosen payment method. If payment fails, we will attempt to charge again and may suspend your access to paid features until payment is resolved.
You may cancel your paid subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. We do not provide pro-rated refunds for partial billing periods. After cancellation, your account reverts to the free tier.
Refunds are provided at our discretion. If you believe you have been charged in error, contact us at [email protected] within 14 days of the charge.
Certain features (such as White-Label Portal and API Access) are available as paid add-ons for eligible plans. Add-ons are billed monthly alongside your subscription and can be cancelled separately.
You retain ownership of all data you provide to the Service, including website configurations, analytics data collected from your websites, and content you create within the platform. We do not claim ownership of your data.
You grant us a worldwide, royalty-free licence to use, process, store, and display your data solely for the purpose of providing and improving the Service. This licence ends when you delete your data or your account.
You may export your data at any time through the Service interface or by contacting us. We will provide your data in a structured, commonly used format.
Our collection, use, and protection of your data is governed by our Privacy Policy. Where we process personal data on your behalf (for example, analytics data about your website visitors), we act as a data processor under the UK GDPR, and you act as the data controller. You are responsible for ensuring you have the appropriate legal basis and notices in place for the data collected from your website visitors.
If you install the Agent Lite tracking script on your website, you are responsible for:

The Service allows you to connect third-party accounts and services (such as Facebook, Instagram, Google, GitHub, Shopify, Slack, Netlify, Vercel, Salesforce, and QuickBooks). When you connect an integration:
The Service, including its software, design, documentation, trademarks, and branding, is owned by LinkRivers and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described here.
You may not copy, modify, distribute, or create derivative works based on the Service without our written consent. Any feedback, suggestions, or ideas you provide to us about the Service may be used by us without obligation to you.
We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Free tier: The free tier is provided on an as-is basis with no service level commitments.
Paid tiers: While we strive for high availability on paid plans, we do not provide a formal Service Level Agreement (SLA) unless separately agreed in writing. If the Service experiences prolonged downtime affecting paid users, we may, at our discretion, offer service credits.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from vulnerabilities. We do not guarantee the accuracy or completeness of any data provided by the Service, including uptime statistics, SEO metrics, analytics data, or third-party integration data.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
You agree to indemnify and hold harmless LinkRivers, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of:

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
